About The Provider
Every Nexus Letter is personally prepared and signed by David Protaziuk, FNP-C — never templated, generic, or outsourced.
Nurse Practitioner Opinions Carry the Same Evidentiary Weight as a Physician's
Federal Law Definition
The VA defines “competent medical evidence” as evidence from any qualified medical professional — NPs are explicitly included under 38 C.F.R. § 3.159(a)(1).
Cannot Be Rejected by Title
The VA cannot reject a medical opinion solely because it was written by an NP instead of an MD. The law is clear on this point.
Reasoning Over Title
The Court of Appeals for Veterans Claims confirmed: the value of a medical opinion depends on its reasoning and evidence — not the provider’s title. (Nieves-Rodriguez v. Peake, 2008)
VA Uses NPs for Official C&P Exams
The VA routinely uses Nurse Practitioner to conduct official Compensation & Pension (C&P) disability examinations — the very exams used to rate veterans’ claims.
Legal Authority
- 38 C.F.R. § 3.159(a)(1) — Defines "competent medical evidence" to include qualified medical professionals such as Nurse Practitioner.
- Nieves-Rodriguez v. Peake, 22 Vet. App. 295 (2008) — Court of Appeals for Veterans Claims: opinion value is based on reasoning and evidence, not provider title.
Why VA Claims Get Denied
Many VA disability claims are denied due to insufficient medical nexus evidence.
No clear medical nexus between service and the condition
Insufficient medical rationale in the opinion
Secondary conditions not properly documented
Toxic exposure claims lacking medical support
Medical evidence not clearly linking condition to service
